CAPFIN SA (PTY) LTD. TERMS AND CONDITIONS (NCRCP11812)

Herewith the Terms and Conditions of Loan Agreement (in terms of section 93(2) of the National Credit Act No. 34 of 2005 (‘the Act”) for Capfin SA (Pty) Ltd (“Capfin”). These Terms and Conditions form part of and are to be read together with the voice-recorded Pre-Agreement Statement and Quotation and Loan Agreement. Any reference to “agreement· hereunder will mean the voice­recorded Pre-Agreement Statement and Quotation and Loan Agreement together with these Terms and Conditions.

1. INTRODUCTION

1.1 Capfin is registered with the National Credit Regulator (“NCR”) and subscribes to the National Credit Act.

1.2 Should you wish to lodge a complaint you can contact the NCR on 0860 627 627 or Capfin on 087 354 0000.

1.3 The agreement is concluded once Capfin approves your loan application. The granting of the loan is entirely within the discretion of Capfin.

1.4 Any amendment made to the agreement will only be legally binding once Capfin has notified you in writing of such amendment.

2. PAYMENT SCHEDULE

The payment schedule attached to these Terms and Conditions sets out the information relating to the loan amount approved and must be read as part of this agreement.

3. INTEREST RATE

3.1 The interest rate is fixed for the duration of the agreement and is calculated on the daily balance and capitalised monthly (added to the outstanding loan balance) on the last day of the month.

3.2 In the event that an arrears amount exists on your account due to non-payment or late payment, the interest rate applicable to such amount in arrears shall not exceed the maximum interest rate applicable to your agreement under the NCA.

3.3 Should Capfin change the interest rate, the amount of fees or charges applicable to your account or the frequency or time of payment of a credit fee or charge as provided for in the NCA, Capfin will notify you in writing by way of SMS of the proposed change/s at least 5 business days before such change is implemented.

3.4 Capfin is entitled (with or without notice to you) to waive its entitlement to a portion of any initiation fees due and payable in respect of new loans when granting new loans to certain categories of customers (such categories to be determined by Capfin in its absolute and sole discretion which may include existing customers). Any such waiver by Capfin of its rights to charge full initiation fees will not alter or amend the nature of this credit agreement.

4. PRE-AGREEMENT DISCLOSURE

4.1 You have the right to delay concluding this agreement by 5 business days in order to consider the terms of the agreement.

4.2 If you elect, within the above 5 business day period, to conclude the proposed agreement, the agreement will be on the same terms (and at or below the interest rate and cost) as originally quoted to you during your telephonic conversation with our call centre.

4.3 Interest will be charged from the date that the money is paid to you by Capfin and not from the date that the quote was given to you.

5a. REPAYMENT TERMS FOR DEBIT ORDERS GRANTED UNDER NAEDO REPAYMENT OPTION.

5.1 Once the loan amount has been paid into your bank account, you will be responsible for repayment of the total amount as stipulated in the agreement (being the loan amount together with interest and all other charges such as administrative costs).

5.2 You will furnish a debit order in respect of any amount payable under the agreement and you consent to the following:

5.2.1 Capfin will raise a debit order to your account to collect your instalments on the instalment date or on such other date as your employer may deposit your salary;

5.2.2 Where your instalment date is on the day following a public holiday, Capfin will raise the debit order on the previous business day;

5.2.3 Where your instalment date is on the last day of the month, Capfin will raise the debit order on the previous day of that month;

5.2.4 Where your instalment date is on the 1st of the month, Capfin will raise the debit order on the 30th of the previous month;

5.2.5 Payment Instructions due in December may be debited against your account on the Friday prior to the 14th of December, unless otherwise agreed between the parties;

5.2.6 PLEASE NOTE where any of these instalments are due on a weekend, Monday or public holiday, Capfin will raise the debit order on the previous business day;

5.2.7 The reference on your bank statement for all Capfin debit orders will be Capfin;

5.2.8 If there are insufficient funds available to deduct your instalment, Capfin will be entitled to track your account and represent the instruction for payment as soon as sufficient funds are available in your account.

5.3 Should your account fall into arrears, you will furnish a debit order in respect of any amount payable under the agreement and you consent to the following additional terms:

5.3.1 Where your instalment date is between the 2nd to the 14th, Capfin will raise the debit order on the 25th of the previous month;

5.3.2 Where your instalment is on the 15th, 23rd, 24th, Capfin will raise the debit order on the previous business day;

5.3.3 Where your instalment date is between the 25th and 1st, Capfin will raise the debit order on the 23rd of the month;

5.3.4 Payment instructions due in December may be debited against your account on the Friday following the 4th of December, unless otherwise agreed between the parties.

5.3.5 PLEASE NOTE where any of these debit orders are raised on a weekend, Monday or public holiday, Capfin will raise the debit order on the previous business day.

5.4 You are expected to repay the full contractual amount in monthly instalments via debit order for the period specified in the agreement by the due date. Should there be a problem with the debit order, the onus is on you to make alternate payment arrangements prior to the instalment due date to prevent penalty interest or legal costs being applied to the account.

5b. REPAYMENT TERMS FOR DEBIT ORDERS GRANTED UNDER DEBICHECK REPAYMENT OPTION.

5.1 Once the loan amount has been paid into your bank account, you will be responsible for repayment of the total amount as stipulated in the agreement (being the loan amount together with interest and all other charges such as administrative costs)

5.2 You will furnish a debit order in respect of any amount payable under the agreement and you consent to the following:

5.2.1 Capfin will raise a debit order to your account to collect your instalments on the instalment date or on such other date as your employer may deposit your salary;

5.2.2 PLEASE NOTE where any of these instalments are due on a weekend or public holiday, Capfin may raise the debit order on the previous business day;

5.2.3 The reference on your bank statement for all Capfin debit orders will be Capfin;

5.2.4 If there are insufficient funds available to deduct your instalment, Capfin will be entitled to track your account and represent the instruction for payment as soon as sufficient funds are available in your account.

5.2.5 All monthly instalments and any payment arrangements will be deducted from your recently approved and validated banking details. This means in the event that the provided banking details is not valid or not approved by yourself, Capfin will be entitled to debit any existing valid bank account.

5.2.6 Should your account fall into arrears, Capfin will be entitled to collect an additional amount of up to one and a half times of the agreed instalment amount. This amount is in addition to the monthly instalment amount.

5.3 You are expected to repay the full contractual amount in monthly instalments via debit order for the period specified in the agreement by the due date. Should there be a problem with the debit order, the onus is on you to make alternate payment arrangements prior to the instalment due date to prevent penalty interest or legal costs being applied to the account.

6. CAPFIN’S RIGHT TO TERMINATE THE AGREEMENT

If you fail to make any payment punctually, you agree that Capfin may immediately claim the entire amount you owe in terms of the agreement from you (which includes, without limitation, loan amounts, arrear interest and any other monies owing against the outstanding loan amount). In these circumstances, Capfin may enforce the agreement by taking the following steps:

6.1 Capfin may advise you in writing or by way of SMS that you are in default and propose that you refer the agreement to a debt counsellor, alternative dispute resolution agent, consumer court or om bud with jurisdiction in order to resolve any dispute under the agreement or agree on a plan to bring the payments up to date.

6.2 If you have been in default for at least 20 business days and at least 10 business days have elapsed since Capfin sent you notice as set out in 6 and you have not responded to the notice, or have responded by rejecting Capfin’s proposals, Capfin may approach a court for an order to enforce the agreement.

6.3 You may at any time before Capfin has cancelled the agreement, remedy your default by paying to Capfin all amounts that are overdue, together with Capfin’s permitted default charges and reasonable costs of enforcing the agreement up to the time you remedy your default.

7. STATEMENTS

You agree to receive a quarterly statement of account which will be delivered to you by ordinary mail or by email to the posted or email address as provided by you in this agreement. Capfin will, at your request, provide you with a statement setting out all charges levied, all payments made and the balance outstanding.

8. EARLY SETTLEMENT

8.1 You consent to the following:

8.1.1 To contact Capfin in person to obtain a settlement quote in the event that you want to settle your loan before the end of its term. You acknowledge that no third party will be allowed to settle your loan on your behalf.

8.2 You are entitled to terminate this agreement at any time by settling the outstanding loan balance ahead of schedule at any time, with or without prior notice to Capfin. The amount required to settle the loan account is the total of the unpaid balance of the principal debt and the unpaid interest charges and other fees and charges payable up to the settlement date.

8.3 You will only pay a pro rata share of the interest for the time you have had the money if you settle the loan amount ahead of schedule.

8.4 Despite having received a settlement value from Capfin, you remain responsible for making sure that all amounts due by you to Capfin (including without limitation, interest charges and administrative costs) have been settled in full.

9. LOAN AGREEMENT DEFAULT

If you do not comply strictly with the rules set out in this agreement, commit any act of insolvency, are sequestrated, make any untrue statements or representations, fail to disclose any information that is pertinent to the loan application or do anything that may prejudice the rights of Capfin, Capfin may, without prejudice to any other right that may accrue to Capfin, claim the full amount outstanding which includes, without limitation, the loan amount, arrear interest or any other monies owing against the outstanding loan amount. In these circumstances, the procedural steps set out in 6 above shall apply.

10. JURISDICTION

In terms of section 45 of the Magistrates’ Court Act, 32 of 1944, you hereby consent that Capfin may institute any legal proceedings that have to do with this agreement or your account, in the Magistrates’ Court. You consent that we may institute action in any Magistrates’ Court, which, in terms of section 28 of the Magistrates’ Court Act, has jurisdiction over you. If we have to go to court for any reason related to this agreement, you will have to appear in the Magistrates’ Court. We can however choose to institute action against you in any court having jurisdiction.

11. DEFAULT ADMINISTRATION AND COLLECTION COSTS

11.1 Should you be in arrears with your monthly instalments and should Capfin take steps to enforce the agreement in terms of the Act, you shall be liable for all default administration charges and collection costs incurred by Capfin or its appointed collections agent, including collection commissions, costs of an attorney and such other reasonable expenses incurred by Capfin or its appointed collections agent, in enforcing this agreement (such as telephone calls and letters to you), subject to the provisions of the Act.

11.2 Capfin will not collect or its appointed collections agent, attempt to collect any amounts for costs exceeding costs allowed for in terms of the Act, Magistrates’ Court Act No. 32 of 1944, the Supreme Court Act No. 59 of 1959 or the Debt Collectors Act No. 114 of 1998.

12. ADDRESSES

12.1 You choose the address as stated in the agreement as the address at which you will accept service of legal documents and notices.

12.2 If you have an address change, you are responsible for informing Capfin of the new address either in writing or telephonically as soon as possible.

12.3 Capfin’s chosen address and contact detail for all purposes under this agreement is as follows, namely: telephone number 087 354 0000 or SMS ‘CASH’ to 43679, postal address PO Box 6507, Parow East, 7501 and physical address at 1 Industrie Street, Kuils River, 7580.

13. CERTIFICATE

A certificate signed by a Capfin manager (who need not prove that appointment), will be sufficient proof of the balance outstanding under the loan and any other terms of the loan, unless proven otherwise.

14. CESSION

Capfin reserves the right, at any time and without notice to you, to cede any or all of its rights in and/or claims against you to a third party elected by Capfin. By acceptance of this agreement, you hereby irrevocably and unconditionally consent to such cession.

15. WHOLE AGREEMENT

The terms of this agreement are the complete and full terms of the agreement between you and Capfin and there are no additional unspoken or implied terms and conditions, unless amended by agreement and in terms of 1.4 above.

16. MARKETING OPTION

When applying for a loan from Capfin, you are entitled to request to be excluded from any or all of the following:

16.1 Telemarketing campaigns conducted by or on behalf of Capfin;

16.2 Marketing and customer lists that are sold or distributed by Capfin, other than as required by the Act;

16.3 Any mass distribution of email or sms messages.

You will be requested to exercise this right during the loan application process. The options you select will appear on the payment schedule attached to this agreement. You’re entitled at any time to contact Capfin and request that the options selected by you be amended.

17. PERSONAL INFORMATION CONSENT

17.1 You consent to:

17.1.1The processing of your personal information (“PI”) by Capfin, Pepkor group companies and any of their operators, commercial partners, agents and sub-contractors (who may be outside South Africa) on condition they will keep such information confidential;

17.1.2 The collection of your PI from any other sources to add to the PI which Capfin has about you;

17.1.3 Capfin, Pepkor group companies and its commercial partners using your PI and communicating with you regarding products, services, research and special off ers that may be of interest or value to you (marketing).

17.2 If you choose to be excluded from direct marketing campaigns, you must advise Capfin in writing or register a block on the relevant registry which Capfin is bound by law to recognise. Capfin will not charge you a fee to update this request on its systems. Capfin will give eff ect to any changes requested by you as soon as reasonably possible.

18. CREDIT ENQUIRY AND REPORTING

18.1 You consent to Capfin conducting a credit enquiry about you and confirming your details with any credit bureau, credit provider or third party and providing your PI, including the manner in which you conduct your account, to:

a) credit risk management services (including credit bureaux); and/or
b) crime prevention agencies.

18.2 Capfin may transfer and share your Pl and information about your loan application, termination and non-compliance with this terms and conditions to the following credit bureaus:

19. YOUR RIGHTS

19.1 In terms of the NCA you have the right to:

  1. contact a credit bureau;
  2. have your credit record disclosed;
  3. correct inaccurate information listed at a bureau;
  4. resolve a complaint by way of alternative dispute resolution or fi le a complaint with the NCR or make an application to the National Consumer Tribunal (“the Tribunal”);
  5. apply to a debt counsellor to be declared over-indebted in terms of the NCA and to have your debt obligations rescheduled.

19.2 The contact details of the NCR and the Tribunal are as follow:

DECLARATION AND AUTHORISATION BY APPLICANT

I, the applicant declare and agree that:

The information that I have provided for the purposes of concluding this agreement is true and correct;

I have not taken up any further credit other than that which already existed at the time I applied for this loan from Capfin;

Capfin can add outstanding amounts, relating to my previous loans which have not been settled, to my new loan balance and adjust my monthly repayments on my new loan in accordance with my new loan balance;

Where instalments are deducted from my bank account, I may not close the bank account unless I have informed Capfin of the change and Capfin has agreed to it and I will make sure that my salary is paid into the indicated account until the entire loan (together with all administrative charges and interest) has been repaid;

Notification in terms of Section 72 (1) of the National Credit Act may be given to me by way of SMS;

I will personally contact Capfin to obtain a settlement quote in the event that I want to settle my loan before the end of its term. I acknowledge that a third party may not settle my loan on my behalf;

By accepting this agreement I give Capfin permission to:

Contact anyone to check that the information which I have provided for the purposes of concluding this agreement is correct;

Obtain details from any party about my financial status and banking details, including my credit record and payment history;

Give information about this loan to any party, including any credit bureau or National Loans Register;

Disclose to a third party my credit record and payment history;

Disclose my PI in the following instances:

  • where Capfin is legally compelled to do so;
  • where it is in the public interest to disclose my PI;
  • where disclosure is made at my request or with my written consent.

CAPFIN SA (EDMS.) BPK.BEPALINGS EN VOORWAARDES (NKRKV11812)

Hiermee die Bepalings en Voorwaardes van ’n Leningsooreenkoms (ingevolge artikel 93(2) van die Nasionale Kredietwet Nr. 34 van 2005 (“die Wet”) vir Capfin SA (Edms.) Bpk. (“Capfin”). Hierdie Bepalings en Voorwaardes vorm deel van en moet saamgelees word met die stemopname van die Voorooreenkomsverklaring en Kwotasie en Leningsooreenkoms. Enige verwysing na “ooreenkoms” hieronder sal die stemopname van die Voor-ooreenkomsverklaring en Kwotasie en Leningsooreenkoms saam met hierdie Bepalings en Voorwaardes beteken.

1. INLEIDING

1.1 CAPFIN is by die Nasionale Kredietreguleerder (NKR) geregistreer en onderskryf die Nasionale Kredietwet.

1.2 Indien u ’n klagte of beswaar wil indien, kan u die NKR by 0860 627 627, of CAPFIN by 087 354 0000 skakel.

1.3 Die ooreenkoms is gesluit sodra CAPFIN u aanbod aanvaar en u leningsaansoek goedkeur. Die toestaan van die lening berus ten volle op die diskresie van CAPFIN.

1.4 Enige wysiging aan die ooreenkoms sal slegs regsbindend word wanneer CAPFIN u skriftelik oor sodanige wysiging ingelig het.

2. AFBETALINGSKEDULE

Die afbetalingskedule aangeheg by hierdie Bepalings en Voorwaardes bevat die inligting rakende die leningsbedrag aanvaar en goedgekeur. Dit moet dus as deel van hierdie ooreenkoms gelees word.

3. RENTEKOERS EN GELDE

3.1 Die rentekoers is vasgestel (bly dieselfde) vir die volle duur van die ooreenkoms en rente word op die daaglikse balans bereken en maandeliks op die laaste dag van die maand gekapitaliseer (by die uitstaande balans van die lening gevoeg).

3.2 In die geval waar ’n agterstallige bedrag op die rekening ontstaan weens nie- of laat betalings, sal die rentekoers van toepassing op sodanige agterstallige bedrag nie die maksimum rentekoers van u lening ingevolge die Nasionale Kredietwet (NCA) oorskry nie.

3.3 Indien CAPFIN die rentekoers, die bedrag van diensgeld of koste van toepassing op u rekening, of die frekwensie of tydstip van betaling van ’n kredietfooi of -koste soos voorsiening voor gemaak is in die NCA, sou verander, sal CAPFIN u ten minste 5 werksdae voordat sodanige verandering geïmplementeer word, skriftelik daaroor inlig.

3.4 CAPFIN is daarop geregtig om (met of sonder kennisgewing aan u) afstand te doen van sy aanspraak op ’n gedeelte van enige aanvangsgelde betaalbaar ten opsigte van nuwe lenings aan sekere kategorieë van kliënte. (Sodanige kategorieë sal volgens CAPFIN se absolute en alleendiskresie bepaal word en kan bestaande kliënte insluit.) Enige sodanige afstanddoening deur CAPFIN van sy regte om die volle aanvangsgelde te vra, sal nie die aard van hierdie kredietooreenkoms verander of wysig nie.

4. VOOR-OOREENKOMS SE BEKENDMAKING

4.1 U is geregtig daarop om die sluiting van hierdie ooreenkoms met 5 werksdae uit te stel om die bepalings van die ooreenkoms te oorweeg.

4.2 Indien u binne bogenoemde 5 werksdae sou besluit om die voorgestelde ooreenkoms en die sluiting daarvan te aanvaar, sal dieselfde bepalings (en dieselfde of laer renkoers en koste) geld as wat gedurende u telefoongesprek met ons inbelsentrum bespreek is.

4.3 Rente sal gehef word vanaf die datum waarop die geld deur CAPFIN aan u uitbetaal word en nie vanaf die datum waarop u die aanbod in die telefoongesprek met ons inbelsentrum gemaak het om die leningsooreenkoms te sluit nie.

5.a TERUGBETALINGSBEPALINGS VIR DEBIETORDERS WAT ONDER DIE NAEDO-TERUGBETALINGSOPSIE TOEGESTAAN IS.

5.1 Sodra die leningsbedrag by u bankrekening inbetaal is, sal u verantwoordelik wees vir die terugbetaling van die totale bedrag soos in die ooreenkoms gestipuleer (die leningsbedrag saam met die rente en alle ander kostes soos administratiewe gelde).

5.2 U sal ’n debietorder magtig met betrekking tot enige bedrag betaalbaar ingevolge die ooreenkoms en u stem in tot die volgende:

5.2.1 CAPFIN sal ’n debietorder op u rekening plaas om u paaiement op die betaaldatum in te vorder, of op sodanige ander datum waarop u werkgewer u salaris inbetaal;

5.2.2 Waar u betaaldatum op die dag ná ’n vakansiedag val, sal CAPFIN die debietorder op die vorige werksdag invorder;

5.2.3 Waar u betaaldatum op die laaste dag van die maand val, sal CAPFIN die debietorder op die vorige dag van daardie maand invorder;

5.2.4 Waar u betaaldatum op die eerste dag van die maand val, sal CAPFIN die debietorder op die 30ste van die vorige maand invorder;

5.2.5 Opdragte vir betaling in Desember kan reeds op die Vrydag voor die 14de Desember teen u rekening gedebiteer word, tensy anders ooreengekom deur die partye;

5.2.6 NEEM ASSEBLIEF KENNIS dat waar enige van hierdie paaiemente op ’n naweek, Maandag of openbare vakansiedag betaalbaar is, CAPFIN die debietorder op die vorige werksdag sal invorder;

5.2.7 Die verwysing op u bankstaat vir alle CAPFIN-debietorders sal CAPFIN wees;

5.2.8 Indien die balans in u rekening onvoldoende is om die paaiement af te trek, sal CAPFIN daarop geregtig wees om u rekening na te gaan en instruksie te gee vir betaling so gou as voldoende geld in u rekening beskikbaar is.

5.3 Indien u rekening agterstallig sou raak, sal u ’n debietorder magtig vir enige bedrag betaalbaar ingevolge die ooreeenkoms. U stem voorts in tot die volgende bykomende bepalings:

5.3.1 Waar u betaaldatum tussen die 2de en die 14de van die maand val, sal CAPFIN die debietorder op die 25ste van die vorige maand invorder;

5.3.2 Waar u betaaldatum op die 15de, 23ste of 24ste val, sal CAPFIN die debietorder op die vorige werksdag invorder;

5.3.3 Waar u betaaldatum tussen die 25ste en die 1ste val, sal CAPFIN die debietorder op die 23ste van die maand invorder;

5.3.4 Opdragte vir betaling in Desember kan reeds op die Vrydag wat op die 4de Desember volg teen u rekening gedebiteer word, tensy anders ooreengekom deur die partye;

5.3.5 NEEM ASSBELIEF KENNIS dat waar enige van hierdie debietorderdatums op ’n naweek, Maandag of openbare vakansiedag val, CAPFIN die debietorder op die vorige werksdag sal invorder.

5.4 Van u word verwag om die volle kontraktuele bedrag in maandelikse paaiemente oor die tydperk en op die betaaldatum in die ooreenkoms gespesifiseer per debietorder te betaal. Indien daar probleme met die debietorder sou ontstaan, rus die onus op u om
alternatiewe reëlings vir betaling voor die paaiementsbetaaldatum te tref om boeterentes of regskoste op die rekening te voorkom.

5.b TERUGBETALINGSBEPALINGS VIR DEBIETORDERS WAT ONDER DIE DEBICHECK-TERUGBETALINGSOPSIE TOEGESTAAN IS.

5.1 Sodra die leningsbedrag in jou rekening betaal is, sal jy vir die terugbetaling van die volle bedrag, soos in die ooreenkoms gestipuleer, aanspreeklik wees (dit wil sê die leningsbedrag plus rente en enige ander kostes, soos byvoorbeeld administratiewe kostes).

5.2 Jy sal ’n debietorder met betrekking tot enige betaalbare bedrag onder die ooreenkoms voorsien en jy stem tot die volgende in:

5.2.1 CAPFIN sal ’n debietorder op jou rekening hef om jou paaiemente op die afbetalingsdatum in te vorder, of op die datum waarop jou werkgewer jou salaris inbetaal.

5.2.2 LET ASSEBLIEF OP dat, indien enige van dié datums op ’n naweek of ’n openbare vakansiedag val, CAPFIN die debietorder op die voorafgaande werkdag sal hef.

5.2.3 Die verwysing vir alle CAPFIN-debietorders op jou bankstaat sal CAPFIN wees.

5.2.4 Indien onvoldoende fondse beskikbaar is om jou paaiement te verhaal, sal CAPFIN geregtig wees om jou rekening na te gaan en opdrag te gee vir betaling sodra voldoende fondse in jou rekening beskikbaar is.

5.2.5 Alle maandelikse paaiemente en enige betaalreëlings sal van die bankbesonderhede wat pas goedgekeur en bevestig is, afgetrek word. Dit beteken dat, indien die bankbesonderhede wat voorsien is nie geldig is of nie deur jou goedgekeur is nie, CAPFIN geregtig sal wees om enige bestaande, geldige bankrekening te debiteer.

5.2.6 Indien jou rekening agterstallig raak, sal CAPFIN geregtig wees om ’n addisionele bedrag van tot een-en-’n-half keer die ooreengekome afbetalingsbedrag in te vorder. Hierdie bedrag is bykomend tot die maandelikse afbetalingsbedrag.

5.3 Daar word van jou verwag om die volle kontraktuele bedrag teen die betaaldatum in maandelikse paaiemente via ’n debietorder gedurende die tydperk wat in die ooreenkoms gespesifiseer is, terug te betaal. Indien daar ’n probleem met die debietorder is, is die onus op jou om alternatiewe betaalreëlings te tref voor die afbetalingsdatum ten einde strafrente of regskostes op die rekening te vermy.

6. CAPFIN SE REG OM DIE OOREENKOMS TE BEËINDIG

In die geval dat u in gebreke bly om enige betaling stiptelik te doen, stem u in dat CAPFIN die hele bedrag wat u ingevolge die ooreenkoms skuld, onmiddellik van u mag eis en verhaal. (Dit sluit sonder beperkings geleende bedrae, agterstallige rente en enige ander gelde in wat met die uitstaande leningsbedrag verband hou.) In so ’n geval kan
CAPFIN die ooreenkoms afdwing deur die volgende stappe te doen:

6.1 CAPFIN kan u skriftelik of per SMS laat weet dat u betaling agterstallig is en voorstel dat u die ooreenkoms na ’n skuldberader, alternatiewe geskilbeslegtigingsagent, verbruikershof of die betrokke ombud met jurisdiksie verwys met die oog op die beslegtiging van enige geskil oor die ooreenkoms, of om oor ’n plan ooreen te kom om die agterstallige bedrae te vereffen.

6.2 Indien u betaling vir ten minste 20 werksdae agterstallig is en ten minste 10 werksdae verloop het vandat CAPFIN ’n kennisgewing soos in klousule 6 aan u gestuur het, en u nog nie op die kennisgewing gereageer het nie, of gereageer het deur CAPFIN se bewerings en voorstelle te verwerp, mag CAPFIN ’n hof nader vir ’n bevel om die ooreenkoms af te dwing.

6.3 U kan enige tyd voordat CAPFIN die ooreenkoms gekanselleer het u wanbetaling regstel deur alle uitstaande bedrae aan CAPFIN te betaal, saam met CAPFIN se toegelate wanbetalingskostes en redelike koste vir die afdwinging van die ooreenkoms tot op die tydstip dat u u wanbetaling reggestel het.

7. REKENINGSTATE

U stem in om ’n kwartaallikse rekeningstaat te ontvang wat per gewone pos of per e-pos aan die pos- of e-posadres gestuur sal word wat u in hierdie ooreenkoms verskaf het. CAPFIN sal op u versoek ’n staat verskaf wat al die kostes gehef, alle betalings gemaak en die uitstaande balans aantoon.

8. VROEË AFLOSSING

8.1 U stem in tot die volgende:

8.1.1 Om CAPFIN persoonlik te kontak om ’n skikkingskwotasie te kry in die geval dat u u lening voor die einde van die vasgestelde termyn wil vereffen.

8.2 U is daarop geregtig om hierdie ooreenkoms enige tyd te beëindig deur die uitstaande leningsbalans voor skedule te betaal, met of sonder kennisgewing daaroor vooraf aan CAPFIN . Die bedrag wat vereis word om die leningsrekening te vereffen is die totaal van die onbetaalde balans van die hoofskuld en die onbetaalde rentekoste en ander gelde en kostes betaalbaar tot op die vereffeningsdatum.

8.3 U sal net ’n pro rata-deel van die
rente vir die tyd wat u die geld gehad het betaal indien u die leningsbedrag
voor skedule terugbetaal.

8.4 Nieteenstaande ontvangs van ’n skikkingsbedrag/waarde van CAPFIN, bly u verantwoordelik daarvoor om seker te maak dat alle bedrae deur u betaalbaar aan CAPFIN (insluitend sonder beperking, renteheffings en administratiewe kostes) ten volle vereffen is.

9. NIENAKOMING VAN LENINGSOOREENKOMS

Indien u nie streng by die reëls soos in hierdie ooreenkoms uiteengesit is hou nie, u insolvent raak, gesekwestreer word, enige onwaar verklarings of voorstellings maak, in gebreke bly om enige inligting bekend te maak wat belangrik en van toepassing op die leningsaansoek is, of enigiets doen wat die regte van CAPFIN in gevaar kan stel, mag CAPFIN, sonder benadeling van enige ander reg wat CAPFIN mag toekom, die vereffening van die volle uitstaande bedrag van u eis. Laasgenoemde sluit sonder beperking die leningsbedrag in, asook agterstallige rente of enige ander gelde geskuld
ingevolge die uitstaande leningsbedrag. In hierdie geval sal die prosedure en stappe soos in 6 hierbo uiteengesit, geld.

10. JURISDIKSIE

Ingevolge artikel 45 van die Landdroshofwet, 32 van 1944, stem u hiermee in dat CAPFIN enige regsprosedures wat met hierdie ooreenkoms of u rekening verband hou, in die Landdroshof kan instel. U stem in dat CAPFIN regsoptrede in enige Landdroshof kan instel wat ingevolge artikel 28 van die Landdroshofwet jurisdiksie oor u het. Indien CAPFIN hof toe moet gaan oor enige rede wat met hierdie ooreenkoms verband hou, sal u self in die Landdroshof moet verskyn. Ons kan egter verkies om optrede teen u in te stel in enige hof met die nodige jurisdiksie.

11. ADMINISTRASIE- EN INVORDERINGSKOSTE IN GEVAL VAN WANBETALING

11.1 Indien u agterstallig raak met u maandelikse paaiemente en CAPFIN stappe sou doen om die ooreenkoms ingevolge die Wet af te dwing, sal u aanspreeklik wees vir alle
wanbetaling-administrasie- en invorderingskostes aangegaan deur CAPFIN, of sy aangestelde invorderingsagent. Dit kan invorderingskommissies insluit, asook
prokureurskoste en sodanige ander redelike uitgawes aangegaan deur CAPFIN of sy
aangestelde invorderingagent in die proses om hierdie ooreenkoms af te dwing (soos telefoonoproepe en briewe aan u), onderhewig aan die bepalings van die Wet.

11.2 Nóg CAPFIN, nóg sy aangestelde invorderingsagent sal probeer om enige kostebedrag bokant die koste toegelaat ingevolge wetgewing, naamlik die Landdroshofwet Nr. 32 van 1944, die Hoogeregshofwet Nr. 59 van 1959 of die Skuldinvorderaarswet Nr. 114 van 1998, in te vorder.

12. ADRESSE

12.1 U kies die adres soos in die ooreenkoms vervat as die adres waar u diens- of regsdokumente en kennisgewings wil ontvang.

12.2 In die geval dat u adres verander, is u verantwoordelik daarvoor dat CAPFIN so gou moontlik skriftelik of per telefoon oor die nuwe adres ingelig word.

12.3 CAPFIN se gekose adres en kontakbesonderhede vir alle doeleindes van hierdie ooreenkoms is soos volg:

13. SERTIFIKAAT

’n Sertifikaat onderteken deur ’n CAPFIN-bestuurder (wat nie nodig sal hê om bewyse van sy aanstelling te verskaf nie) sal voldoende bewys wees van die uitstaande balans van die lening en enige ander bepalings van die lening, tensy die teendeel bewys kan word.


14. SEDERING

CAPFIN behou die reg voor om te enige tyd en sonder kennisgewing aan u, enige of al sy regte ingevolge die ooreenkoms en/of eise teen jou aan ’n derde party, gekies deur CAPFIN, te sedeer. By aanvaarding van hierdie ooreenkoms, stem u onherroeplik en onvoorwaardelik in tot sodanige oordrag/sedering.

15. VOLLE OOREENKOMS

Die bepalings van hierdie ooreenkoms is die volledige en allesomvattende bepalings van die ooreenkoms tussen u en CAPFIN. Daar is geen addisionele ongeskrewe of geïmpliseerde bepalings en voorwaardes nie, tensy wysigings ná wedersydse instemming en ’n ooreenkoms ingevolge 1.4 hierbo, aangebring word.

16. BEMARKINGSOPSIE

Wanneer u aansoek doen vir ’n lening van CAPFIN, is u geregtig om te versoek om van enige van die volgende uitgesluit te word:

16.1 Telefoonbemarkingsveldtogte onderneem deur of namens CAPFIN;

16.2 Bemarking- en kliëntelyste wat deur CAPFIN verkoop of versprei word, anders as dit wat deur wetgewing vereis word;

16.3 Enige massaverspreiding van e-posse of SMS-boodskappe.

U sal as deel van die aansoekproses versoek word om hierdie reg uit te oefen. Die opsie wat u kies, sal op die betalingskedule verskyn wat by hierdie ooreenkoms aangeheg is. U kan CAPFIN enige tyd kontak en versoek om die opsies wat u gekies het, te verander.

17. INSTEMMING RAKENDE PERSOONLIKE INLIGTING

17.1 U stem in tot:

17.1.1 Die verwerking van u persoonlike inligting (“PI”) deur Capfin, Pepkor-maatskappygroep, maatskappye in die Pepkor-groep en enige van hul bedryfsarms, kommersiële vennote, agente en subkontrakteurs (wat buite Suid-Afrika mag wees), op voorwaarde dat hulle sodanige inligting as vertroulik hanteer;

17.1.2 Die insameling van u PI van enige ander bronne om by te voeg by die PI wat CAPFIN oor u het;

17.1.3 Die gebruik van u PI deur die Capfin, Pepkor-maatskappygroep en hul kommersiële vennote en kommunikasie met u oor produkte, dienste, navorsing en spesiale aanbiedinge wat van belang of waarde vir u kan wees (bemarking).

17.2 Indien u versoek om uitgesluit te word van regstreekse bemarkingsveldtogte moet u CAPFIN hieroor skriftelik inlig of ’n blokkering aanbring op die relevante registrasiemeganisme wat CAPFIN dan ingevolge wetgewing verplig is om in ag te neem. CAPFIN sal geen koste hef om hierdie versoek op sy stelsels te verander of by te werk nie. CAPFIN sal ook so gou as wat redelik moontlik is, gehoor gee aan enige veranderinge deur u versoek.

18. KREDIETNAVRAE/ONDERSOEK EN VERSLAGDOENING

18.1 U stem in dat CAPFIN ’n kredietondersoek oor u doen en bevestiging by enige kredietburo, kredietverskaffer of derdeparty oor u besonderhede kry. U stem voorts in dat u PI en die manier waarop u u rekening hanteer, verskaf mag word aan:

a) kredietrisikobestuursdienste (insluitende kredietburo’s; en/of

b) misdaadvoorkomingsagentskappe.

18.2 CAPFIN kan u PI en inligting oor u leningsaansoek, die moontlike beëindiging en nienakoming van hierdie bepalings en voorwaardes aan die volgende kredietburo’s oordra of met hulle deel:

19. U REGTE

19.1 Ingevolge die NKW het u die reg om:

a) ’n Kredietburo te kontak;

b) U kredietrekord aan te vra;

c) Verkeerde of onakkurate inligting wat ’n kredietburo het, te laat regstel;

d) ’n Klagte deur middel van ’n alternatiewe geskilbeslegtigingsmeganisme op te los, of om ’n klagte by die NKR in te dien, of ’n aansoek te rig aan die Nasionale Verbruikerstribunaal (“die Tribunaal”);

e) By ’n skuldberader aansoek te doen dat u skuld ingevolge die NKW as te groot verklaar word en u skuldverpligtinge herskeduleer word.

VERKLARING EN MAGTIGING DEUR AANSOEKER

Ek, die aansoeker verklaar en stem in dat:

Die inligting wat ek verskaf het vir die doeleiendes van die sluit van hierdie ooreenkoms waar en korrek is;

Ek nie enige verdere krediet geneem het bo en behalwe die wat reeds aan my toegestaan was op die tydstip dat ek vir hierdie lening van CAPFIN aansoek gedoen het nie.

CAPFIN uitstaande bedrae wat verband hou met my vorige lenings wat nie ten volle terugbetaal is nie, by my nuwe lening se balans kan voeg en die maandelikse terugbetalings op my nuwe lening ooreenkomstig die nuwe balans op my rekening kan aanpas.

Waar paaiemente van my bankrekening afgetrek word, ek nie die betrokke bankrekening mag sluit tensy ek CAPFIN daarvan in kennis gestel het en CAPFIN daartoe ingestem het nie. Ek sal voorts seker maak dat paaiemente van my salaris afgetrek en by die betrokke leningsrekening inbetaal word totdat die lening (sowel as alle administratiewe kostes en rente) ten volle terugbetaal is.

Kennis ingevolge Artikel 72(l) van die Nasionale Kredietwet aan my gegee kan word deur middel van ’n SMS;

Ek CAPFIN persoonlik sal kontak om ’n skikkingskwotasie te kry in die geval dat ek my lening voor die einde van sy termyn wil terugbetaal. Ek neem kennis dat ’n derde party nie my lening namens my kan aflos nie.

Deur hierdie ooreenkoms te aanvaar gee ek toestemming aan CAPFIN om:

- Enigiemand te kontak om na te gaan of die inligting wat ek verskaf het vir die doeleindes van die sluit vanhierdie ooreenkoms korrek is;

- Besonderhede van enige party te bekom oor my finansiële posisie en bankbesonderhede, insluitende my kredietrekord en afbetalingsgeskiedenis;

- Inligting oor hierdie lening aan enige party te gee, insluitend enige kredietburo of die Nasionale Leningsregister;

- My kredietrekord en afbetalingsgeskiedenis aan ’n derde party bekend te maak.

- Waar CAPFIN ingevolge die reg verplig is om dit te doen;

- Waar dit in openbare belang is om my PI openbaar te maak;

1.ISINGENISO

1.1 Abakwa-CAPFIN babhalisiwe noMlawuli Kazwelonke Wezikweletu (“NCR”) futhi bangaphansi koMthetho Kazwelonke Wezikweletu.

1.2 Uma ufisa ukufaka isikhalazo ungaxhumana ne-NCR ku-0860 627 627 noma abakwa-CAPFIN ku-087 354 0000.

1.3 Isivumelwano siphothulwa uma abakwa-Capfin sebekwamukele lokho okubeka etafuleni futhi besigunyaza isicelo sakho semalimboleko. Ukunikezelwa
kwemalimboleko kulele entandweni yabakwa-Capfin ngokuphelele.

1.4 Nanoma yisiphi isichibiyelo esenziwa esivumelwaneni sizoqala ukubophezela ngokusemthethweni uma abakwa-Capfin sebekwazisile ngokukubhalela incwadi ngaleso sichibiyelo.

2. UHLELO LOKUKHOKHA

Uhlelo lokukhokha olufakwe kule Migomo kanye neMibandela luveza obala ulwazi oluhlobene nenani lemalimboleko eyamukelwe futhi egunyaziwe futhi-ke kufanele lufundwe njengengxenye yalesi sivumelwano.

3. ISILINGANISO SENZALO KANYE NEZINHLAWULO

3.4 Abakwa-Capfin banemvume (ngokukunikeza isaziso noma ngaphandle kwesaziso kuwena) yokuyekelela ilungelo labo engxenyeni yanoma yiziphi izinhlawulo zokuvula isikweletu okumele zikhokhwe nokufanele zikhokhwe maqondana nezimalimboleko ezintsha lapho kunikezelwa ngezimalimboleko ezintsha emikhakheni ethile yabathengi (leyo mikhakha ezonqunywa ngabakwa-Capfin ngokuzithandela nangentando yabo kuphela okungenzeka kubandakanye nabathengi abakhona kakade). 4. ISIDALULO ESANDULELA ISIVUMELWANO

4.1 Unelungelo lokubambezela ukuphothula lesi sivumelwano ngezinsuku zokusebenza ezi-5 ukuze uzocubungulisisa imibandela yesivumelwano.

4.2 Uma unquma, esikhathini sezinsuku eziyi-5 ezibekwe ngenhla, ukuphothula isivumelwano esihlongoziwe, isivumelwano sizokuba sisenemibandela efanayo (futhi sizokuba sisenesilinganiso senzalo esifanayo noma ngaphansi kanye nezindleko) njengoba bekudingidiwe engxoxweni yakho yocingo kanye nesikhungo sethu sezingcingo.

4.3 Inzalo izobizwa kusukela ngosuku imali ekhokhelwa ngalo kuwena ngabakwa-CAPFIN hhayi ngosuku owenza ngalo isinqumo sokuphothula isivumelwano semalimboleko engxoxweni yocingo kanye nesikhungo sethu sezingcingo.

inkokhelo ngokuphazima kweso ngemuva kokuba sekukhona imali eyanele kwi-akhawunti yakho.

5b. IMIGOMO YOKUKHOKHWA KWAMA-DEBIT ORDER NGAPHANSI KOHLELO LWE-DEBICHECK INDLELA YOKWENZIWA KWENKOKHELO.

5.1 Uma inani lemalimboleko selikhokhiwe ku-akhawunti yakho yasebhange, uzoba Nomthwalo wokukhokhwa kwesamba esiphelele semali njengoba kubaluliwe esivumelwaneni (okuyisamba semalimboleko nenzalo kanye nazo zonke ezinye izinkokhelo ezifana izindleko zokuphathwa kwesikweletu).

5.2 Uzohlinzeka nge-debit order malungana nanoma yiliphi inani okufanele likhokhwe ngaphansi kwesivumelwano futhi uyavumelana nalokhu okulandelayo:

5.2.1 Abakwa-CAPFIN izohlela i-debit order ku-akhawunti yakho ukuze badonse izitolimende ngosuku lwakhona noma ngosuku lapho umqashi wakho afaka ngalo umholo wakho;

5.2.2 QAPHELA uma ezinye zalezi zitolimende kufanele zidonswe ngempelasonto noma ngeholide lomphakathi, abakwa-CAPFIN bangase badonse i-debit order ngasuku olungaphambili olungusuku lomsebenzi;

5.2.3 Ireferensi esitatimendeni sakho sasebhange sawo wonke ama-debit order akwa-CAPFIN kuyoba ngu-CAPFIN;

5.2.4 Uma kukhona imali enganele ukuba kudonswe isitolimende sakho, abakwa-CAPFIN bazoba nelungelo lokulandelela i-akhawunti yakho futhi babeke umyalelo wokuba kukhokhwe masinyane lapho imali eyanele seyikhona ku-akhawunti yakho.

5.2.5 Zonke izitolimende zenyanga kanye nanoma yimaphi amalungiselelo okukhokha azodonswa emininingwaneni yakho yasebhange esanda kunikezwa. Lokhu kusho ukuthi uma kwenzeka ukuthi imininingwane yasebhange ehlinzekiwe ayisebenzi noma yigunyazwanga nguwena, abakwa-CAPFIN bazoba nelungelo lokudonsa imali kunoma iyiphi i-akhawunti yasebhange esebenzayo.

5.2.6 Uma i-akhawunti yakho isilela emuva, abakwa-CAPFIN bazoba nelungelo lokudonsa inani elengeziwe elifinyelela engxenyeni eyodwa nohhafu wesamba sesitolimende okuvunyelwene ngaso. Lesi samba singaphezu kwesamba sesitolimende senyanga.

6. ILUNGELO LABAKWA-CAPFIN LOKUNQAMULA ISIVUMELWANO

Uma uhluleka ukwenza nanoma iyiphi inkokhelo ngesikhathi, uyavuma ukuthi abakwa-Capfin bangafuna inkokhelo yenani eliphelele ngokushesha kuwena olikweletayo ngokwesivumelwano (okubandakanya, ngaphandle kwemikhawulo, amanani emalimboleko, inzalo yemali esilele, kanye nanoma yiziphi ezinye izinhlawulo ozikweletayo enanini lemalimboleko elisele). Kulezi zimo, abakwa-Capfin bangaqinisa isivumelwano ngokuthatha lezi zinyathelo ezilandelayo:

6.1 Abakwa-Capfin bangakweluleka ngokukubhalela incwadi noma ngendlela ye-SMS ngokuthi usilele emuva bese bephakamisa ukuba udlulisele isivumelwano kumeluleki wezikweletu, kwelinye inxusa elixazulula izingxabano, enkantolo yabathengi noma kumxazululi onemvume ukuze kuxazululwe nanoma iyiphi ingxabano ngaphansi kwesivumelwano noma kuvunyelwane ngecebo lokufinyelelisa izinkokhelo lapho kumele zibe khona.

6.2 Uma usilele emuva okungenani ngezinsuku ezingama-20 zokusebenza futhi sekuphele okungenani izinsuku eziyi-10 zokusebenza kusukela abakwa-Capfin bekuthumelele isaziso njengoba kuveziwe ku-6 futhi ungakaphenduli kuleso saziso, noma usuphendule ngokuchitha iziphakamiso ezenziwe ngabakwa-Capfin, abakwa-Capfin bangaya enkantolo ukuyocela imvume yokuqinisa isivumelwano.

7. IZITATIMENDE

Uyavuma ukuthola isitatimende ngekota se-akhawunti esizothunyelwa kuwena ngendlela ejwayelekile yeposi noma nge-imeyili ekhelini elihlinzekwe kuwena kulesi sivumelwano. Abakwa-Capfin, uma ucelile, bazokuhlinzeka ngesitatimende esiveza zonke izinhlawulo ezifakiwe, zonke izinkokhelo esezenziwe kanye nemali esasele ngemuva.

8. UKUKHOKHA SONKE ISIKWELETU NGAPHAMBI KWESIKHATHI

8.1 Uyavuma kulokhu okulandelayo:

8.1.1 Ukuxhumana nabakwa-Capfin siqu sakho ukuze uthole isilinganiso semali yokuvala isikweletu esimweni lapho ufuna ukukhokhela yonke imalimboleko yakho ngaphambi kokuphela kwethemu yayo. Uyakwamukela ukuthi akekho omunye umuntu ngaphandle kwakho ozovunyelwa ukukhokhela ukukhokhela yonke imalimboleko yakho egameni lakho.

8.2 Unelungelo lokuqeda lesi sivumelwano noma yinini ngokukhokha yonke imali esele kwimalimboleko ngaphambi kohlelo lwezinkokhelo nganoma yisiphi isikhathi, ngokufaka noma ukungafaki isaziso ngaphambi kwesikhathi nabakwa-Capfin. izitatimende ezingelona iqiniso kanye nokumeleleka, uhluleka ukudalula nanoma yiluphi ulwazi olusemqoka esicelweni semalimboleko, noma wenze noma yini engabeka amalungelo abakwa-Capfin engcupheni, abakwa-Capfin ngaphandle kokulimaza nanoma yiliphi elinye ilungelo elingaqongeleleka kwabaka-CAPFIN, bangafuna inani eliphelele olikweletayo elibandakanya, ngaphandle kwemikhawulo, inani lemalimboleko, inzalo yemali esilele, kanye nanoma yiziphi ezinye izinhlawulo ozikweletayo enanini lemalimboleko elisele). Kulezi zimo, izinyathelo zenqubo ezivezwe ku-6 ngenhla zizosebenza ngokuqinile.

10. AMANDLA ESIKHUNDLA

Ngokwesigaba sama-45 soMthetho Wenkantolo Kamantshi, wama-32 ka-1944, uyavuma lapha ukuthi abakwa-Capfin bangathatha nanoma yiziphi izinqubo zomthetho eziphathelene
nalesi sivumelwano noma i-akhawunti yakho, eNkantolo Kamantshi. Uyavuma ukuthi singafaka icala kunoma iyiphi iNkantolo Kamantshi, ngokwesigaba sama-28 soMthetho Wenkantolo Kamantshi, enamandla esikhundla ngaphezu kwakho. Uma kumele siye enkantolo nganoma yisiphi isizathu esihlobene nalesi sivumelwano, kuyomele uzovela eNkantolo Kamantshi. Nakuba kunjalo singakhetha ukufaka icala ngawe kunoma iyiphi inkantolo enandla esikhundla.

11. UKUPHATHWA KOMSEBENZI WOKUSILELA NGEMUVA KANYE NEZINDLEKO ZOKUQOQWA KWEMALI

11.1 Uma kwenzeka usilela emuva ngezitolimende zakho zenyanga futhi uma kwenzeka abakwa-CAPFIN bethatha izinyathelo zokuqinisa isivumelwano ngokoMthetho, uzokuba necala lokukhokhela zonke izinhlawulo zokuphathwa komsebenzi wokusilela ngemuva kanye nezindlleko zokuqoqwa kwezimali ezidalwe ngabakwa-Capfin noma inxusa labo eliqokiwe lokuqoqa izimali, kubandakanya namakhomishini okuqoqa izimali, izindleko zommeli kanye nezinye izindleko ezifanelekile ezidalwe ngabakwa-Capfin noma inxusa labo eliqokiwe lokuqoqa izimali, ekuqiniseni lesi sivumelwano (ezinjengokushaywa kwezingcingo kanye nokubhalwa kwezincwadi eziza kuwena), kuncike ezimisweni zoMthetho.

11.2 Abakwa-Capfin abasoze noma inxusa labo eliqokiwe lokuqoqa izimali bazame ukuqoqa nanoma yimaphi amanani ezindleko edlula izindleko ezivumelekile ngokoMthetho, uMthetho Wenkantolo Kamantshi onguNombolo 32 ka-1944, uMthetho Wenkantolo Ephakeme onguNombolo 59 ka-1959 noma uMthetho Wabaqoqi Bezikweletu onguNombolo 114 ka-1998.

12. AMAKHELI

13. ISITIFIKETI

Isitifiketi esisayindwe ngumphathi wakwa-Capfin (okungadingekile ukuba afakazele lokho kuqashwa), sizokuba ngubufakazi obanele bemali esele ngaphansi kwemalimboleko
kanye nanoma yimiphi eminye imibandela yemalimboleko, ngaphandle uma kuchazwe ngenye indlela.

14. UKUYEKELELA

Abakwa-CAPFIN bagodla ilungelo, nganoma yisiphi isikhathi futhi ngaphandle kokukunikeza isaziso, lokuyekelela nanoma yiliphi noma wonke amalungelo abo ezicelweni

15. ISIVUMELWANO ESIPHELELE

16. INDLELA YOKUTHENGISA

Uma ufaka isicelo semalimboleko kwabakwa-Capfin, unelungelo lokucela ukuba ungafakwa kunoma yikuphi noma kukho konke okulandelayo:

16.1 Imikhankaso yokuthengisa ngocingo eyenziwa ngabakwa-Capfin noma egameni labo;

16.2 Ukuthengisa kanye nohlu lwabathengi oluthengiswa noma olusatshalaliswa ngabakwa-Capfin, ngaphandle kwalokho okudingwa nguMthetho;

16.3 Nanoma yikuphi ukusatshalaliswa ngobuningi kwama-imeyili noma imiyalezo ye-SMS.

17. IMVUME YOLWAZI OLUQONDENE NOMUNTU SIQU

17.1 Uyavuma kulokhu:

17.1.1 Ukucutshungulwa kolwazi lwakho oluqondene nawe siqu (“PI”) yi-Capfin, izinkampani zeqembu le-Pepkor, izinkampani eziseqoqweni lakwa-Pepkor
kanye nanoma yibaphi abasebenzeli bazo, abalingani okusetshenziswana nabo kwezentengiselwano, amanxusa kanye nosonkontileka abangaphansi kwabanye (okungenzeka ukuthi bangaphandle kwaseNingizimu Afrika) inqobo nje uma bezogcina lolo lwazi luyimfihlo;

17.1.2 Ukuqoqwa kwe-PI yakho kunoma yimiphi eminye imithombo ukuze kwengezwe kwi-PI abakwa-CAPFIN abanayo ngawe;

17.1.3 I-Capfin, izinkampani zeqembu le-Pepkor, izinkampani eziseqoqweni lakwa-Pepkor kanye nabalingani bazo bezentengiselwano abasebenzisa i-PI yakho futhi
baxhumane nawe maqondana nemikhiqizo, izinsizakalo, ucwaningo kanye nezithembiso ezikhethekile okungenzeka ube nogqozi kuzona noma zibe yigugu kuwena (ukuthengisa).

17.2 Uma ukhetha ukungafakwa emikhankasweni yokuthengisa okuqondile, kufanele weluleke abakwa-CAPFIN ngokubhalwe phansi noma ubhalise isivimbelo kwirejista
efanelekile abakwa-Capfin abaphoqwe ngumthetho ukuba bayibone futhi bayazise. Abakwa-CAPFIN ngeke bakuhlawulise ngokuvuselela lesi sicelo ezinhlelweni zabo. Abakwa-CAPFIN bazoqalisa ukusebenza kwanoma yiziphi izinguquko ezicelwe nguwena ngokuphazima kweso.

18. UPHENYO LWEZIKWELETU KANYE NOKUBIKA

18.1 Uyabavumela abakwa-Capfin ukuba benze uphenyo lwezikweletu ngawe futhi baqinisekise imininingwane yakho nanoma yisiphi isikhungo sezikweletu, umhlinzeki wezikweletu noma umuntu wangaphandle futhi bahlinzeke nge-PI yakho kubandakanya nendlela oyiphatha ngayo i-akhawunti yakho:

a) kwizinsizakalo zokuphathwa kobungozi bezikweletu (kubandakanya nesikhungo sezikweletu); kanye/noma

19. AMALUNGELO AKHO

4. INKCAZO YAPHAMBI KWESIVUMELWANO

4.1 Unelungelo lokulibazisa ukugqiba esi sivumelwano kwiintsuku ezi-5 zokusebenza ukuze uqwalasele imimiselo nemiqathango.

4.2 Ukuba kwiintsuku ezi-5 zokusebenza ukhetha ukugqiba isivumelwano esindululiweyo, eso sivumelwano siza siza kuba phantsi kwemimiselo (kwaye sibe kwimilinganiselo okanye sibe ngaphezulu kwemilinganiselo yeendleko zemalinzala) njengoko bekuxoxiwe ngaphambili kwincoko yomnxeba yakho neziko lethu loncedo.

5a. IMIMISELO YOBUYISOMALI NGEEDEBHIT ODA OLUGUNYAZISWE PHANTSI KWENDLELA YOBUYISOMALI EKHETHEIWEYO YE-NAEDO.

5.1 Sakube sihlawuliwe isixamali kwiakhawunti yakho yebhanki, uza kubanoxanduva lokubuyisa intlawulomali yaso sonke isixamali esichaziweyo kwisivumelwano (esisixamali semalimboleko kunye nemalinzala nazo zonke iitshajizi ezifana neendleko zolawulo).

5.2 Uza kufaka idebhit oda ngokubhekiselel kuso nasiphi na isixamali esihlawulwayo phantsi kwesivumelwano kwaye uvumile koku kulandelayo:-

5.2.1 I-CAPFIN iza kwenza idebhit oda kwiakhawunti yakho ukukoleka ii-instolmenti ngomhla weinstolment okanye ngomnye umhla anokuthi umqeshi wakho adipozithe ngawo umvuzo wakho.

5.2.2 Apho umhla weinstolment yakho ungomhla olandela iholide kawonkewonke, iCAPFIN iza kwenza idebhit oda kusuku lokusebenza olungaphambili;

5.2.3 Apho umhla weinstolment yakho ungomhla wokugqibela enyangeni, iCAPFIN iza kwenza idebhit oda kusuku lokusebenza olungaphambili;

ingxaki ngedebhit oda, lulele kuwe uxanduva lokwenza ezinye iindlela zokuhlawula instolmenti phambi komhla ehlawulwa ngawo ukuphepha imalinzala esisohlwayo okanye iindleko zezomthetho ezisebenzayo kule akhawunti.

5b. IMIMISELO YOBUYISOMALI NGEEDEBHIT ODA OLUGUNYAZISWE PHANTSI KWENDLELA YOBUYISOMALI EKHETHEIWEYO YE-DEBICHECK.

5.1 Sakuba sihlawuliwe isixamali mboleko kwiakhawunti yebhanki yakho, uza kuba noxanduva lokusibuyisa sonke isixamali esichazwe kwisivumelwano (esisisixamali mboleko kunye nenzala nazo zonke ezinye iindleko ezifana nezo zolawulo).

5.2 Uza kufaka idebhit oda ngokwesixamali esihlawulwayo phantsi kwesivumelwano kwaye uvumile koku kulandelayo:

5.2.1 U-CAPFIN uza kutsala imali kwiakhawunti yakho ngedebhit oda ukuqokelela ii-instolmenti ngomhla ekudipozithwe ngawo umvuzo wakho ngumqeshi wakho;

5.2.2 NCEDA UQAPHELE ukuba apho umhla wokutsalwa kwezi instolmenti ungempelaveki okanye ngeeholide zikawonkewonke, uCAPFIN angayitsala idebhit oda ngosuku lokusebenza olungaphambili kolo;

5.2.3 Ireferensi kwisteytimenti sakho sebhanki yazo zonke iidebhit oda iza kuba nguCAPFIN;

5.2.4 Ukuba akukho mali yoneleyo yokuba makutsalwe kuyo i-instolmenti yakho, uCAPFIN uselungelweni lokulandel’ umkhondo weakhawunti yakho kwaye anike umyalelo wokuba mayibuyisw’ imali ngoko nangoko xa kukho imali eyoneleyo kwiakhawunti yakho.

5.2.5 Zonke ii-instolmenti zenyanga nawo nawaphi na amalungiseleo okwenza intlawulo ziza kutsalwa kwiakhawunti yakho yamva nje yebhanki eneenkcukacha ezivunyiweyo neziqinisekisiweyo. Oku kuthetha ukuba kwimeko apho iinkcukacha zebhanki ozinikezeleyo azisebenzi okanye awuzivumanga, uCAPFIN uza kuba selungelweni lokudebhita nayiphi na iakhawunti yebhanki yakho esebenzayo.

5.3. Ulindeleke ukuba isihlawule sonke siphelele isixamali ekuvunyelwene ngaso ngee-instolmenti zenyanga usebenzisa idebhit oda ngexesha ekuvunyelwene ngalo. Kwakubakho ingxaki nedebhit oda, luxanduva lwakho ukuba wenze ezinye iinzame zokuhlawula phambi kokufika komhla weinstolmenti ukuthintela ukufakelwa kwemalinzala okanye kweendleko zezomthetho ezizizohlwayo kwiakhawunti yakho.


6. AMALUNGELO E-CAPFIN OKUPHELISA ISIVUMELWANO

Ukuba uyasilela ukwenza nayiphi na intlawulo, uyavuma ukuba iCAPFIN ingasibanga sonke isixamali osityalayo ngokwesivumelwano sakho (esiquka, ngaphandle kwesinyino, izixamali zemalimboleko, imzalinzala yeearitezi nazo naziphi na ezinye iimali ozityalayo zemalimboleko). Kwezi meko, iCAPFIN inganyanzela isivumelwano ngokuthatha la manyathelo alandelayo:

6.1 I-CAPFIN ingakwazisa ngembalelwano okanye ngeSMS ukuba uyasilela ukuhlawula kwaye ikucebise ukuba usidluliselele kumcebisi ngamatyala, okanye kwiarhente yokusombulula iimbambano, kwinkundla yeeakhawunti okanye kuombhutsimani onamagunya ukusombulula nayiphi na imbambano phantsi kwesivumelwano okanye uvumelane ngesicwangciso sokuhlawula ukuze ungabisemva ngentlawulo.

6.2 Ukuba uye wasilela ukuhlawula kangangeentsuku zokusebenza ezingama-20 kwaye noko sele kuphele iintsuku ezi-10 ukusukela oko iCAPFIN yakuthumela isaziso njengoko
kuchaziwe ku-6 kwaye awukhange usiphendule isaziso, okanye uphendule ngokusikhaba isindululo seCAPFIN, iCAPFIN ingaya enkunldeni ukufumana isigunyaziso sokunyanzelisa isivumelwano.

7. IISTEYTIMENTI

Uyavuma ukufumana isteytimenti seakhawunti yakho ngekota esiza kuthunyelwa kuwe ngeposi eqhelekileyo okanye ngeimeyili kwidilesi yeimeyili oyinikezileyo kwisivumelwano. I-CAPFIN iza, ngokwesicelo sakho, kunika isteytimenti esichaza zonke iitshajizi ezirhafaywayo, zonke iintlawulo ezenziweyo kunye nebhalansi oyityalayo.


8. UKUHLAWULA LONK’ ITYALA PHAMBI KWEXESHA

8.1 Uvumile koku kulandelayo:

8.1.1 Ukuqhagamshelana neCAPFIN ngokwesiqu ukufumana ikowuti yokuhlawula lonk’ ityala xa uthe wafuna ukulihlawula lonk’ ityala lemalimboleko yakho phambi kwexesha lalo. Uyavuma ukuba akukho mntu wesithathu uza kuvunyelwa ukuba akuhlawulele lonk’ ityala egameni lakho.

8.2 Unelungelo lokusiphelisa esi sivumelwano nanini na ngokukuyihlawula yonke ibhalansi yalo lonk’ ityala lemalimboleko phambi kwexesha elimiselweyo, uyazisile ungayazisanga iCAPFIN. Isixamali esifunekayo sokuyihlawula yonke iakhawunti yemalimboleko yiyo yonke ibhalansi engakahlawulwa yetyala lokuqala kunye neetshajizi zemalinzala ezingekahlawulwa neminye imirhumo ehlawulwayo ukuya kutsho kumhla wokulihlawula lonk’ ityala.

8.3 Uza kuhlawula kuphela isabelo sobuninzi bemalinzala kangangexesha ubuyithathe ngalo imali xa usihlawula sonke isixamali semalimboleko phambi kwexesha.

8.4 Nangona ulifumene ixabiso lokuyihlawula yonk’ imali kwiCAPFIN, usenoxanduva lokuqinisekisa ukuba zonke izixamali ekumele uzihlawule kwiCAPFIN (kuquka, ngaphandle kwezinyino, iintshajizi zemalinzala neendleko zolawulo) zihlawulwe zonke ngokupheleleyo.


9. UKUSILELA KWISIVUNELWANO SEMALIMBOLEKO

Ukuba awuthobeli ngokuphelelyo imigaqo emiselwe kwesi sivumelwano, wenza nantoni na yokungakwazi ukuhlawula, uyathinjwa, wenza nayo nayiphi na ingxelo okanye umelo
olungeyonyani, uyasilela ukuchaza nazo naziphi na iingcombolo ezinxulumene nesicelo semalimboleko okanye wenze nantoni na ephazamisa amalungelo eCAPFIN, iCAPFIN ingasibanga sonke isixamali osityalayo esiquka, ngaphandle kwesinyino, isixamali semalimboleko, imalinzala yeariyezi okanye nazo naziphi na ezinye iimali ozityala zemalimboleko. Kwezi meko amanyathelo enkqubo achazwe kwisi-6 ngasentla aza kusebenza.


10. IGUNYA LOMTHETHO

Ngokwecandelo 45 lomthetho iMagistrates’ Court Act 32 ka-1944, uyavume ke ngoko ukuba iCAPFIN ingaqalisa iinkqbo zezomthetho ezinento yokwenza nesi sivumelwano okanye neakhawunti yakho, kwiNkundla kaMantyi. Uyavuma ukuba singaqalisa ngeentshukumo nakwiyiphi na iNkundla kaManty, ngokwecandelo 28 lomthetho iMagistrates’ Court Act, unamagunya omthetho kunawe. Ukuba kufuneka siye enkundleni ngenxa yaso nasiphi na isizathu esinxulemene nesi sivumelwano, kuza kufuneka uvele phambi kweNkundla kaMantyi. Nangona kunjalo singawathatha nawaphi na amanyathelo nagkuwe nakweyiphi na inkundla enamagunya omthetho.


11. IINDLEKO ZOLAWULO LOKUSILELA NOKUKOLEKA

11.1 Nje ukuba ubekwiiariyezi kwii-instolmenti zakho zenyanga kwaye yakuthatha amanyathelo okunyanzelisa isivumelwano iCAPFIN ngokoMthetho, uza kubanoxanduva lokuhlawula

12. IIDILESI

12.1 Ukhetha idilesi njengoko uyichazile kwisivumelwano njengedilesi oza kufumana kuyo inkonzo yamaxwebhu omthetho nezaziso.

13. ISATIFIKETI

Isatifiketi esityikitywe ngumphathi weCAPFIN (ongadingi kuqinisekisa eso sikhundla) sakuba bubungqina obaneleyo bebhalansi oyityala phantsi kwemalimboleko nayo nayiphi na imimiselo yemalimboleko, ngaphandle kokuba kungqinwe ngenye indlela.

14. UKUNIKELA

I-CAPFIN inelungelo, nanini na ngaphandle kokukwazisa, yokunikela ngawo nawaphi na amalungelo kunye/okanye amabango enziwa kuwe ngumntu wesithathu okhethwe

15. ISIVUMELWANO SISONKE

16. ONOKUKUKHETHA KORHWEBO

Xa usenza isicelo semalimboleko kuCAPFIN, unelungelo lokucela ukuba ungabandakanywa kuyo nayiphi into kwezi zilandelayo:

17.2 Ukuba ukhetha ukukhutshelwa ecaleni kwimpembelelo yorhwebo olungqalileyo, kufuneka wazise iCAPFIN ngembalelwano okanye ubhalise ibhlok kwirejistri efanelekileyo
enyanzelekileyo iCAPFIN ukuba iyityumbe. I-CAPFIN iza kuqalisa ngalo naluphi na utshintsho olucelileyo ngokukhawuleza kangangoko kunokwenzeka.

18. UKUPHANDA NGAMATYALA NOKUNIK’ INGXELO
