The National Credit Act (No. 34 of 2005), “the Act,” was introduced “To promote and advance the social and economic welfare of South Africans, promote a fair, transparent, competitive, sustainable, responsible, efficient, effective and accessible credit market and industry, and to protect consumers.”

BORROWING MONEY

CAPFIN is a registered credit provider that strives to follow the Act and practice responsible lending with all its existing and potential customers. Therefore, allowing all our customers to fully understand the loan terms and conditions before making any financial commitments. A helpful idea is to draw up a detailed budget to assist in familiarising yourself with all your monthly expenses, managing your finances better and paying your creditors in full and on time. Each of our customers are responsible for the full payment of their loans, the additional charges, as well as the fees and interest. That’s why we advise all our customers to please ensure that they can afford the monthly charges that will accompany our loans as per the CAPFIN loan agreement.

DEBT PROBLEMS

Should you ever find yourself in a position where you are unable to meet your monthly financial commitments, we suggest that you immediately seek help. Below are a few options available if you ever find yourself in financial difficulty:

  1. Contact CAPFIN directly by sending the word “ASSIST” via SMS to 43679 (standard SMS rates apply) and we will call you back in order to make an alternative payment arrangement with you, or if possible, reschedule your current monthly CAPFIN obligations; or
  2. Contact a registered debt counsellor to assist you with the potential rescheduling of all your debt/monthly obligations and help you make arrangements with your creditors, tailored to your existing financial means. The Act makes provision for the debt review process and a registered debt counsellor will explain the procedure to you in detail. You can contact the National Credit Regulator at 0860 627 627 or visit their website at www.ncr.org.za to find a debt counsellor nearest to you; or
  3. Apply for an administration order whereby your estate will be put under administration by means of a court order. By doing this you will not be able to obtain any further debt or credit without the consent of the court, therefore allowing you to repay your creditors.   4. Submit your estate for sequestration, which is much like a company going into liquidation but in this instance for an individual. Basically, a trustee will be appointed to administer your estate to finalise matters with your creditors, preventing you from incurring further debt or being hassled with further legal action against you. The consequences are however far-reaching and should be discussed with a legal representative in detail before such an option is considered.

WHAT IS A CREDIT REPORT?

A credit report is a report done by a credit bureau to set out all your debt, financial obligations, court orders granted against you and any information related to outstanding payments submitted by other credit providers to the credit bureaus. You have the right to request a free copy of your credit report once a year from a registered credit bureau to ensure that all the information on the report is accurate. If you disagree with the information provided on your credit report, raise any concerns with the credit bureau which supplied you with the information.

Die Nasionale Kredietwet 34 van 2005 (“die Wet”) is ingevoer “om die maatskaplike en ekonomiese welsyn van Suid Afrikaners te bevorder en te verbeter, ’n billike, deursigtige, mededingende, volhoubare, verantwoordelike, doeltreffende, doelmatige en toeganklike kredietmark en kredietbedryf te bevorder, en om verbruikers te beskerm”.

LEEN VAN GELD

CAPFIN is ’n geregistreerde kredietverskaffer wat daarna streef om die Wet na te kom en verantwoordelike uitlening met al hulle bestaande en potensiële kliënte te beoefen. Om dus al ons kliënte die leningsterme en -voorwaardes ten volle te laat verstaan voordat hulle enige finansiële verbintenis aangaan. ’n Nuttige idee is om ’n gedetailleerde begroting saam te stel om jou vertroud te maak met al jou maandelikse uitgawes, jou finansies beter te bestuur en om jou krediteurs ten volle en betyds te betaal. Elkeen van ons kliënte is verantwoordelik vir die volledige betaling van hulle lenings, die bykomende heffings sowel as die fooie en rente. Daarom beveel ons al ons kliënte aan om asseblief seker te maak hulle kan die maandelikse heffings bekostig wat ingevolge die CAPFIN-leningsooreenkoms met ons lenings gepaardgaan.

SKULDPROBLEME

Indien jy jou ooit in die posisie bevind dat jy nie in staat is om jou maandelikse finansiële verbintenis na te kom nie, stel ons voor jy kry onmiddellik hulp. Hieronder is ’n paar beskikbare opsies indien jy jou ooit in ’n finansiële verknorsing bevind:

  1. Kontak CAPFIN direk deur die woord “BYSTAND” via SMS na 43679 te stuur en ons sal jou terugbel om ’n alternatiewe betalingsooreenkoms met jou aan te gaan of, indien moontlik, jou huidige maandelikse CAPFIN-verpligtinge te herskeduleer; of
  2. kontak ’n geregistreerde skuldberader om jou by te staan met die potensiële herskedulering van al jou maandelikse skuldverpligtinge en om jou te help om reëlings met jou krediteurs te tref wat gepasmaak is volgens jou bestaande finansiële middele. Die Wet maak voorsiening vir die skuldhersieningsproses en ’n geregistreerde skuldberader sal die prosedure in detail met jou bespreek. Jy kan die Nasionale Kredietreguleerder kontak by 0860 627 627 of hulle webwerf besoek by www.ncr.org.za om die naaste skuldberader aan jou op te spoor; of
  3. doen aansoek vir ’n administrasiebevel, ingevolge waarvan jou boedel deur middel van ’n hofbevel onder administrasie geplaas word. Deur dit te doen, sal jy sonder die toestemming van die hof nie enige verdere skuld kan oploop of krediet kan verkry nie, wat jou in staat sal stel om jou krediteurs terug te betaal. Om meer hieroor uit te vind, kontak jou naaste provinsiale prokureursorde of die Prokureursorde van Suid-Afrika by 012 366 8800 or lssa@lssa.org.za; of
  4. dien jou boedel in vir sekwestrasie, wat baie dieselfde is as ’n maatskappy wat gelikwideer word, maar in hierdie geval vir ’n individu. ’n Trustee sal basies aangestel word om jou boedel te beredder om sake met jou krediteure te finaliseer, en sodoende voorkom dat jy verder skuld oploop en verhoed dat jy met verdere regsaksie teen jou lastig geval word. Die gevolge is egter verreikend en moet in detail met ’n regsverteenwoordiger bespreek word voordat so ’n opsie oorweeg word.

WAT IS ’N KREDIETWAARDIGHEIDSVERSLAG?

’n Kredietwaardigheidsverslag is ’n verslag wat deur ’n kredietburo saamgestel is. Daarin word al jou skuld, finansiële verpligtinge, hofbevele wat teen jou toegestaan is en alle inligting wat verband hou met jou uitstaande betalings wat deur ander kredietverskaffers by die kredietburo’s ingedien is, uiteengesit. Jy het die reg om een keer ’n jaar ’n gratis afskrif van jou kredietwaardigheidsverslag by ’n geregistreerde kredietburo aan te vra om seker te maak al die inligting in die verslag is akkuraat. Indien jy nie met die inligting saamstem wat in jou kredietwaardigheidsverslag verskyn nie, moet jy dit direk opneem met die kredietburo wat jou van die inligting voorsien het.
